When we say "Service" or "Services", we mean the Edicek platform and all its features, whether delivered within a web browser, desktop application, mobile application, or any other format.

1. Acceptance of Terms

By accessing and using Edicek, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.

2. Description of Service

Edicek provides a knowledge management platform that allows users to save, organize, and search their digital content including bookmarks, notes, images, videos, and documents. The service includes AI-powered features for content analysis and retrieval.

AI Processing: Our AI features process your content to provide search and analysis capabilities. This processing happens on secure servers, and we do not use your data to train AI models. You can choose to use or not use AI features at your discretion.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account and password.
• You agree to accept responsibility for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You must be a human. Accounts registered by "bots" or other automated methods are not permitted.

4. User Content

• You retain all rights to the content you save and create on Edicek.
• You grant Edicek a license to store, process, and display your content solely for the purpose of providing the service.
• You are responsible for ensuring you have the right to save and share any content you add to Edicek.

5. Pricing and Payment

• Edicek operates on a pay-as-you-go credit system.
• During early access, pricing may change without prior notice.
• Credits do not expire but are non-transferable.
• Refunds for unused credits may be available within 30 days of purchase, subject to our review and approval.
• For automatic top-ups, we may refund a maximum of your most recent top-up amount.
• Credits must be unused to qualify for a refund.
• All refund requests are evaluated on a case-by-case basis at our sole discretion.
• Approved refunds are processed within 14 days.

6. Prohibited Uses

You agree not to use Edicek to:

• Violate any applicable laws or regulations;
• Infringe upon the rights of others;
• Transmit any malicious code or harmful content;
• Attempt to gain unauthorized access to our systems;
• Use the service for any illegal or unauthorized purpose.

7. Data Backup and Responsibility

While we take reasonable measures to protect and backup your data, we are not responsible for any data loss. You are solely responsible for maintaining your own backups of any important content stored in Edicek.

We strongly recommend you regularly export and backup any critical information stored in our service. Once data is deleted — whether an individual bookmark, note, or your entire account — we cannot recover it from our backups. When you delete content or your account, it is permanently deleted and cannot be restored.

We are not responsible for any content stored outside of the Edicek service, including but not limited to external websites, links, or third-party services that you bookmark or reference within Edicek. We do not monitor, control, or endorse such external content, and you access it at your own risk.

8. Service Modifications

We reserve the right to modify or discontinue the service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

In the event of service discontinuation, any unused credits will be forfeited without compensation unless otherwise announced.

9. Limitation of Liability

Edicek shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. We provide the service "as is" without any warranties.

10. Termination

We reserve the right to terminate or suspend your account and access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your data becomes inaccessible immediately and is permanently deleted within 30 days.

11. Governing Law and Disputes

These Terms of Use and your use of the Service are governed by the laws of the Czech Republic, excluding its conflicts of law rules.

For European Union (EU) Users: If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes that negatively affect their rights via email or through the service. For other changes, you are responsible for regularly reviewing these Terms of Use. Your continued use of Edicek after any modifications constitutes acceptance of the updated terms.
